Philadelphia Ban on Salary History Questions Goes Live This Week. After three years of litigation, the City of Philadelphia will begin enforcing its Wage Equity Ordinance beginning today, September 1. The law makes it illegal for employers, employment agencies, or their agents to ask about an applicant’s current or prior salary history during the application or hiring process for a job in Philadelphia. .
Importantly, the law does not bar employers from asking about a candidate’s salary expectations or competitive offers. It also does not prohibit discussing a candidate’s wage history if the employee voluntarily discloses it without prompting from the employer.
