DecisionQuest continues to enlighten us with its National Juror Attitude Survey, disclosing the results from questioning more than 1,200 potential jurors.
If you are representing a corporation going to trial in an employment case, you might want to inform your client of this finding: while 85% of males believe that corporate America has done a good or excellent job in fighting discrimination and promoting diversity in the workplace, only 52% of females believe it. Racially, while 61% of whites and 63% of Hispanics believe corporate America has done a good or excellent job on this issue, only 42% of African Americans and 35% of Asians feel that way.
And if you’re facing a retaliation claim, the survey supports the conventional wisdom among employment lawyers that these are the most dangerous cases for employers. A super-majority of 69% of respondents agree strongly or somewhat with the statement that “When low-level employees complain to their senior management about some work-related issues, these employees usually get in trouble for doing so.”
